Who’s Entitled to Survivor Social Security Benefits in Pennsylvania?
JENKINTOWN PERSONAL INJURY ATTORNEYS
If a person dies who has worked and paid Social Security taxes, then their surviving family members may be entitled to their benefits. It depends on the person’s relation to the decedent. Here is a list of people who commonly receive benefits:
- Widows and Widowers – If you have reached retirement age, then you can generally get 100 percent of your spouse’s benefits. If you are not at retirement age, you will receive 71.5 to 99 percent of benefits. One exception being that if you are taking care of the decedent’s children, you can get benefits at any age.
- Unmarried Children: Unmarried children under the age of 18 can receive 75 percent of benefits if they are enrolled high school full time. Sometime stepchildren, grandchild, or adopted children can also receive benefits as well.
- Divorced Spouses – Usually if they have not remarried, and the marriage lasted 10 years or more, then at age 60 you can receive benefits as a widow or widower.
- Dependent Parents – Dependent parents who are over the age of 62 can receive benefits. But the deceased son or daughter would have to provide a minimum of half of the parent’s financial aid in order for them to be considered dependent parents.
