Philadelphia Construction Worker Falls 35 Feet at Navy Yard

A 27 year old construction worker was injured this week when he fell from an industrial scissor lift at the Philadelphia Navy Yard. Faulty Equipment is being blamed for the accident. The worker was taken to the Hospital of the University of Pennsylvania and has been reported to be in stable condition. The exact injuries he sustained is unclear.
The worker will be eligible for worker’s compensation benefits under the Pennsylvania Workers’ Compensation Act. He may also have a claim for non-economic damages (such as his pain and suffering) provided the accident was the fault of someone other than his employer. It sounds like the manufacturer of the equipment could have some responsibility or a maintenance company for the equipment if the lack of proper maintenance caused the equipment to fail. The Pennsylvania Workers’ Compensation Act prohibits you (in most situations) from suing your employer for non-economic damages, such as pain and suffering, but does not prohibit you from making a claim against someone other than your employer who may be at fault for your injuries.
