What Type of Compensation Am I Entitled To?
If you were injured, or a loved one was injured or killed, in a motor vehicle accident, you are entitled to compensation for all of your pain and suffering, lost wages, and any future earnings loss you might have. In addition, you may be entitled to have your medical bills paid, either by your own insurance company (your rates do not go up if you are injured and your insurance company pays your medical bills) or, if you are uninsured, through the insurance company for one of the vehicles involved in your accident.
At Mednick, Mezyk & Kredo, we have represented motor vehicle accident victims for many years, and we understand how these accidents affect our clients and their families. We know what to do to get you all the compensation you are entitled to, and will make sure that everything is done to protect your rights, and to assure that you get results as quickly as possible.
What Types of Injuries Can I Receive Compensation For?
Motor vehicle accident victims are entitled to compensation for their pain and suffering for all of the injuries they have suffered, including:
- Fractures, strains and sprains
- Neck and back injuries, including herniated and bulging disks
- Head injuries, including concussions
- Leg injuries
- Arm and hand injuries
- Spinal cord injuries
- Psychological, psychiatric and other emotional injuries
- Any other injuries resulting from the accident
In addition, accident victims are entitled to compensation for any unpaid lost wages, any reduction in how much they can earn in the future and, in certain cases, medical expenses that exceed the amount covered by insurance.
What Is the Difference Between Full Tort and Limited Tort?
When you buy auto insurance in Pennsylvania, you can purchase either “full tort” or “limited tort” coverage. When you buy “full tort” coverage, your family and you are entitled to compensation for all of the pain and suffering you experience as a result of a motor vehicle accident, including pain and suffering, medical bills, lost wages, loss of enjoyment of life, and the loss of spousal support, regardless of how serious the injury is.
If you bought “limited tort” insurance, you saved about 10 percent on your insurance bill, but gave up the right to sue for pain and suffering – even if the other driver was negligent – unless you suffered a “serious injury.” In Pennsylvania, the Courts have ruled that a “serious injury” is a very serious injury, and whiplash and other injuries that heal quickly are not serious injuries.
At Mednick, Mezyk & Kredo, we regularly represent auto accident victims who are covered by either the full tort or the limited tort options. We understand how to prove that our clients’ injuries are serious, and can often show that even though our clients are “limited tort,” they are still entitled to compensation for their pain and suffering.
Our motor vehicle accident attorneys will make sure that every person and family we represent receives our undivided attention, maximum effort and extraordinary service.
