The 4 Stages of Social Security Disability Appeals Pennsylvanians Need to Know

JENKINTOWN PERSONAL INJURY ATTORNEYS

The notification that you were dreading has arrived. Your Social Security disability claim has been denied. The government has told you that the money that you need to support yourself after becoming disabled is not coming. You may be, understandably, discouraged and frightened. However, you have not yet lost the opportunity to get the financial support that you need. You still have the right to pursue a Social Security disability appeal.

What is a Social Security Disability Appeal?

Generally, Social Security disability appeals follow four stages. Specifically, the different appeal stages include:

  1. Reconsideration. Reconsideration involves having someone who was not part of the initial decision review your entire file to make an independent determination about eligibility. The person reviewing your case may consider everything you presented in your initial application and any new information that you have to present.
  2. Hearing Before an Administrative Law Judge.  A hearing is typically held after a reconsideration. You may be asked to provide more information prior to the hearing, and you have the right to attend the hearing.
  3. Review by the Appeals Council. The third stage of review is a review by the Appeals Council. While the Appeals Council will consider all requests for review, it may deny a review if it believes the decision of the Administrative Law Judge was correct in your Social Security disability appeals hearing.
  4. Review in a Federal Court. You may have the right to file a case in federal district court if you disagree with the Appeals Council.

An experienced Pennsylvania Social Security disability attorney can advise you about the steps that you need to take to file an appropriate appeal if your initial Social Security disability claim has been denied. Once you are successful at one stage of appeal, you do not need to continue the appeals process.
