What is the difference between full tort and limited tort?

JENKINTOWN PERSONAL INJURY ATTORNEYS

Purchasing car insurance can be pretty confusing for some people, and many are looking for the least expensive option, so they may end up making choices about their policy that they don’t understand.

When you buy auto insurance in Pennsylvania, one thing you can purchase is either “full tort” or “limited tort” coverage. Limited tort is priced more cheaply, and it is required by Pennsylvania state law that your coverage be at least as much as limited tort insurance provides. Full tort costs more, but is going to give you more protection.

Here’s a breakdown of what you can expect when you choose either limited tort or full tort:

Full Tort in Pennsylvania

You and your family are entitled to compensation for all of the pain and suffering you experience as a result of a Pennsylvania motor vehicle accident, regardless of how serious the injury is. This includes:

  • Medical bills
  • Lost wages
  • Loss of enjoyment of life
  • Loss of spousal support

Limited Tort in Pennsylvania

You saved about 10 percent on your insurance bill, but gave up the right to sue for pain and suffering—even if the other driver was negligent—unless you suffered a “serious injury.” In Pennsylvania, a serious injury means any bodily injury that creates a substantial risk of death or which causes serious, permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ. Whiplash and other injuries that heal quickly are not serious injuries.

At Mednick, Mezyk & Kredo, we regularly represent auto accident victims who are covered by either the full tort or the limited tort options. We understand how to prove that our clients’ injuries are serious, and can often show that even though our clients are “limited tort,” they are still entitled to compensation for their pain and suffering.
