What are some of the reasons why Pennsylvania citizens are denied Social Security Disability Insurance?
JENKINTOWN PERSONAL INJURY ATTORNEYS
There are many reasons why a Pennsylvania citizen can be turned down for Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI). In some cases, the reasons may reach beyond the individual’s control. At other times, you may have done something that results in a denial. Some reasons for denial are as follows:
- You exceed the maximum income allowed. For Social Security Disability Insurance, there is a limit on how much money you are allowed to earn on a monthly basis. The Social Security Administration established substantial gainful activity (SGA) limits on earned wages. The maximum income allowed per month is $1,040 in 2013. This amount is adjusted annually.
- Your disability will not last long enough. In order to qualify for benefits, the Social Security Administration must believe that your disability/impairment is so severe that it will last for at least 12 months, or result in your death. The exception to the duration clause is blindness.
- The Social Security Administration can’t find you. The Disability Determination Service (DDS) must be able to contact you regarding your application. If for any reason the agency cannot reach you, your benefits can be denied.
- Your refusal to cooperate. If you refuse to release your medical records for agency research, your claim can be denied. In some instances, the Social Security Administration may wish to have you medically examined by one of their doctors if your medical records are incomplete.
- If you do not follow through on prescribed therapy. Your benefits can be denied if your doctor prescribes therapy and you fail to follow it through.
The Social Security Administration can deny you benefits for any number of reasons. They have at certain times, however, made mistakes that have been reversed. If you believe you have been denied benefits wrongfully, the experienced social security attorneys at MMK Law will be able to answer any questions you may have about your denied application.
