My child was injured at daycare and suffered a concussion. Do I have a claim for improper supervision?

My 4 year old daughter was injured at our daycare. She tripped and banged her head into the wall. She has been diagnosed with a concussion. Another kid pushed her into the wall as they were running around. I was told that the teacher does not stop the kids from running around and there is lots of horseplay. Does my daughter have a claim against the daycare?

Their responsibilities include providing proper supervision of all children in their programs. Failing to properly monitor the children falls below the appropriate standard of care.
