May I use my own doctor for treatment after being injured on the job in Pennsylvania?

As with so many Pennsylvania workers’ compensation claims, the answer varies depending on the situation. You may treat with the doctor of your choosing if:

  • Your employer has denied your claim.
  • Your employer has accepted your claim, but does not have list of at least six physicians for you to choose from.
  • Has not had you sign the rights and responsibilities document (both at the time of hire and time of accident).

If you treat with your own personal doctor, it is important to remember that under Pennsylvania law, you must notify your employer who is treating you.

If your employer has accepted your claim and/or has a list of suggested physicians or healthcare providers, you must visit a provider on that list for initial treatment. If you plan to continue treatment, you must continue with that provider, or another provider on your employer’s list, for 90 days. You may see any provider on the list and switch to another one. Your employer may not direct you to any specific provider on this list.

Another important thing to note is if a provider has suggested invasive surgery as part of your treatment, you are entitled and permitted to a second opinion. This second opinion is paid for by your employer/insurance company. The treatment dictated by the second opinion must be the course of treatment for 90 days after the second opinion.

It is very important to remember that if you go to a doctor not on your employer’s list, your claim could be denied. While in some cases you may visit your own doctor for treatment, it is important to how the law and rules apply to your specific situation.
