If I accept a lump sum settlement for a workers compensation injury can I return to my job at a later time?

When an employee reaches a lump sum settlement with the employer in his/her Workers’ Compensation Claim it is customary for the employer to require the injured worker to accept a voluntary termination of employment. This is done for a couple of reasons. First, if the injured worker does return to the same employer and is reinjured in the course and scope of his/her employment, the employer could be responsible for paying workers compensation benefits for the new injury or aggravation of the pre-existing condition. Second, by requiring an employee to voluntarily terminate their employment, the employer would avoid having to pay for a later Unemployment Compensation Claim.
Once an injured worker settles his worker’s compensation claim for a lump sum and this settlement is approved by the Workers’ Compensation Judge, the employee is free to find a job and start working for a new employer.
