Employer Retaliation for Workplace Injury an Alarming Trend

New data suggests an alarming new trend in employer retaliation towards employees who are injured on the job. According to statements from the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA), too many workplace injuries go unreported and plan to take a tougher line with employers on this specific problem.
According to Lex Larson, President for Employment Law Research, Inc., about 100 federal and state court cases were decided last year on the topic of retaliation from workers’ compensation claims. A number which Larson estimates is roughly double that of the numbers seen a decade ago.
Under federal law, employers are prohibited from retaliating against any employee for reporting a workplace injury or hazard. Jordan Barab, deputy assistant secretary at OSHA believes that accidents don’t happen because workers are careless, but that “they happen because there are unsafe conditions in the workplace.”
Workers’ compensation programs are aimed at helping those injured on the job to recuperate and seek the proper medical treatment necessary without jeopardizing their livelihood.
