They grow up so fast! It seems it was just yesterday that you were holding her hand for the first day of school. Now she has her first job. Teen jobs are a great way to earn money, learn responsibility, and gain the skills for adult life, but, just like adults, teens can be injured while working.
All workers, including teen employees, are covered by state and federal employment regulations. The Occupational Safety and Health Act (OSH Act) is administered by the U.S. Occupational Safety and Health Administration and provides guidelines for workplace safety. Pennsylvania has additional state laws. There are some Pennsylvania employment laws that are specific to teenagers:
- In most circumstances, children under age 16 may not work.
- A minor child must have a work permit issued by the school district in order to be eligible to work.
- A child under the age of 18 may not work for more than six consecutive days without a day off.
- A child under the age of 18 may not work more than eight hours a day or more than 48 hours a week.
- A child under age 18 may not work more than 28 hours a week while in school.
- A child under age 16 may not work outside of school for more than four hours per day.
- A child under age 18 may not work more than five consecutive hours without a 30-minute break for lunch.
- A minor may not work in an establishment that brews or bottles alcohol.
- A minor may not serve or handle alcoholic beverages in the workplace.
- Minors may not perform dangerous work.
Like adult workers, teens injured while working have rights under Pennsylvania workers’ compensation law. A teen injured on the job can expect that any medical bills related to the injury will be covered by workers’ compensation. If the injury leaves the teen unable to work, she may be eligible for partial payment of wages.
